REALITY star Scotty T has had a personal injury case thrown out – after Instagram showed him cliff-diving in Ibiza while he claimed to be agonising pain.
The former Celebrity Big Brother winner – who’s real name is Scotty Timlin – claimed he was in constant pain 15-months after the 2020 smash, which was another driver’s fault.
But the claim has been thrown out of court after Instagram posts to his 3.2million followers showed him partying in Ibiza just a week after the alleged whiplash.
The images showed the fitness fanatic leaping into the sea, climbing cliffs topless with no ropes, sprinting through sand and doing handstands on cliff walls.
Appearing at Newcastle county court to give evidence, Timlin claimed that the social media posts were old photographs that his agent would re-use to keep his profile active.
But district judge Thomas, found his case flawed and said it was a “mystery” what treatment he had, what problems in his life were caused by his injuries and what the recovery period was.
The court heard, despite his active lifestyle, the former Geordie Shore star tried to claim compensation from esure, who insured the car he had a smash with.
He claimed he had suffered soft tissue injuries to his neck, shoulders, lower back and right hand, telling his medical expert “the injuries were ongoing and severe 15 months later”.
Under cross-examination, Timlin confirmed that he did not in fact sustain any lower back pain and his body and hand did not hit the interior of his car, discrediting his claim further.
Jared Mallinson, partner and head of counter fraud at Horwich Farrelly, which represented eSure, said: “This case is a fantastic example of our intelligence and fraud teams collaborating to help combat fraudulent claims for our clients.
“Social media played a huge part in Mr Timlin being found fundamentally dishonest and our holistic approach demonstrates the results that insurers can achieve.”
The judge threw out the personal injury case against insurer eSure on the basis of a dishonesty finding and ordered Timlin to pay the insurance company’s court costs of £4,282.
